Fair Housing Statement

MiamiApartmentBuildings.com is an independent, ad-free directory of apartment buildings in Miami, Miami Beach, Coral Gables and North Bay Village. It is created and maintained by ChicagoRealEstate.ai. This directory supports equal housing opportunity.

Equal Housing Opportunity

It is unlawful to discriminate in the sale, rental, financing or advertising of housing on the basis of a protected characteristic. Three layers of law apply to the buildings in this directory, and they do not cover the same ground.

Federal law. The Fair Housing Act protects race, color, religion, sex, disability, familial status and national origin.

Florida law. The Florida Fair Housing Act, Chapter 760 of the Florida Statutes, protects race, color, national origin, sex, disability, familial status and religion.

Miami-Dade County law goes considerably further. Chapter 11A of the County Code protects race, color, religion, ancestry, national origin, sex, pregnancy, age, disability, marital status, familial status, sexual orientation, source of income, gender identity or expression, and actual or perceived status as a victim of domestic violence, dating violence or stalking. The county ordinance applies throughout Miami-Dade, including every municipality covered by this directory.

Two of those county categories are worth naming because they have no federal or Florida equivalent. Source of income is protected in Miami-Dade and is not protected under federal or Florida law, which is directly relevant to applicants using a Housing Choice Voucher. Gender identity or expression is likewise protected by the county ordinance and not by the Florida Fair Housing Act.

How This Directory Is Written

This directory describes buildings, not the people who live in them. Listings record building characteristics – unit counts, floors, year built, amenities, parking, pet policies and the nearest rail station – compiled from operators’ own published information and from public records.

This site does not publish tenant preferences or limitations. It does not rank buildings, and it does not accept payment for inclusion or position. Where a field is blank, the information was not confirmed from a reliable source; a blank field is not a statement about the building.

Income-Restricted and Age-Restricted Buildings

Some buildings in this directory are income-restricted, and some are restricted by age. Both are lawful. Where a restriction is known, it is stated on the building’s page.

Income-restricted buildings include properties financed through the Low-Income Housing Tax Credit program, through HUD programs such as HOME, and through local agreements – for example with the Southeast Overtown/Park West Community Redevelopment Agency. Some buildings are entirely income-restricted; others are market-rate with a set-aside of restricted apartments. Income limits are expressed as a percentage of area median income and are reset annually, so this directory does not publish specific income limits or restricted rents. Eligibility is determined by the building’s management.

Age-restricted buildings operate under the housing for older persons exemption to the Fair Housing Act’s familial status protection. To qualify as “55 or older” housing, at least 80 percent of occupied units must be occupied by at least one person aged 55 or older, and the community must publish and follow policies demonstrating its intent to operate as housing for older persons. Where a building in this directory is age-restricted, that is stated in the opening line of its page rather than buried further down.

Nothing on this site is a determination that any person is or is not eligible for any building. Contact the building directly.

Reporting a Concern

If you believe a page on this site contains discriminatory content, or describes a building inaccurately, write to ChicagoApartmentBuildings@gmail.com and it will be reviewed.

To report housing discrimination by a housing provider, these are the agencies that take complaints:

U.S. Department of Housing and Urban Development
1-800-669-9777 · hud.gov/reporthousingdiscrimination

Florida Commission on Human Relations
(850) 488-7082 or (800) 342-8170 · 4075 Esplanade Way, Unit 110, Tallahassee, FL 32399
A complaint must be filed within one year of the last alleged act of discrimination.

Miami-Dade County Commission on Human Rights
305-375-2784 · 111 NW 1st Street, 21st Floor, Miami, FL 33128

Because the Miami-Dade ordinance covers characteristics that federal and Florida law do not, a complaint that falls outside federal or state law may still be actionable at the county level.

Not Legal Advice

This page is informational and is not legal advice. The summaries above are not a complete statement of fair housing law, and that law changes. Anyone with a specific question should consult an attorney or one of the agencies listed above.
